Common questions

How much can a deposit be in Ireland?
For tenancies created since 9 August 2021, the deposit may not exceed one month’s rent – and no more than one further month’s rent may be required in advance (Residential Tenancies (No. 2) Act 2021). If more was demanded, that is worth querying before anything is paid.
Who holds the deposit – is there a protection scheme?
Unlike in the UK, Ireland has no state-approved deposit protection scheme in operation: the landlord simply holds the deposit. All the more reason for a signed receipt stating the amount, the property and the date – and for a condition report at move-in.
What if the deposit isn’t returned at the end?
A deposit may only be withheld for genuine grounds such as rent arrears or damage beyond normal wear and tear. If you disagree, the dispute can be referred to the Residential Tenancies Board’s dispute resolution service – the receipt and the condition report are your core evidence there.
Deposit paid in instalments?
Issue a separate receipt for each instalment with its own date and amount, so the running total is provable at any point.
