Common questions

Promissory note or loan agreement – which do I want?
The loan agreement is the full two-sided contract covering payout and both parties’ duties. The promissory note is the debtor’s one-sided written acknowledgment of the debt – shorter, and mainly there as evidence. For new lending, take the loan agreement; for documenting an existing debt, the note.
Only the debtor signs?
Classically yes – the acknowledgment is the debtor’s. The creditor holds the signed note. If you want both signatures, have the creditor countersign through Tamgara; it does no harm.
What happens when the debt is repaid?
The debtor should get the original note back – or a signed note of discharge. Record part-payments on the note or with receipts as you go, so the outstanding balance is never in doubt.
How long does the note keep its force?
In Ireland, claims on simple contract debts generally become statute-barred six years after they fall due (Statute of Limitations 1957). A written acknowledgment matters here: do not let an unpaid debt drift – demand in writing and take advice if it stays unpaid.
