In brief: letting residential property in Ireland

Residential lettings in Ireland run under the Residential Tenancies Acts: registration with the RTB, capped deposits, statutory notice rules and dispute resolution through the RTB. The written agreement records rent, term, deposit and duties.

Register the tenancy with the RTB within one month of the start – and annually since April 2022.
Deposit: at most one month’s rent, plus at most one month’s rent in advance (tenancies from 9 August 2021).
Statutory tenant protections and notice periods operate alongside the agreement and cannot be contracted away.
Disputes – deposits, notice, rent – go to the RTB’s dispute resolution service rather than straight to court.
Record the condition of the property at move-in; it decides deposit questions at the end.

Common questions

Do I have to register the tenancy?

Yes. Landlords must register each residential tenancy with the Residential Tenancies Board (RTB) within a month of it starting – and since April 2022 the registration must be renewed every year of the tenancy. Failing to register is an offence and blocks access to parts of the RTB process.

How much deposit may I take?

For tenancies created since 9 August 2021, at most one month’s rent as deposit, with no more than one further month’s rent in advance (Residential Tenancies (No. 2) Act 2021). Issue a receipt – Tamgara has a dedicated deposit receipt template.

Fixed term or periodic?

Both are possible – enter a fixed term or leave it periodic. Note that Irish tenancy law gives tenants statutory protections and notice rules that operate alongside whatever the agreement says; the agreement cannot contract below them.

Is a digitally signed letting agreement valid?

A residential letting agreement can be signed electronically – Tamgara creates a simple electronic signature under the EU eIDAS Regulation, which applies directly in Ireland.
