For a private smartphone sale, the two critical points are the IMEI number in the contract and removing the activation lock before handover.

Frequently asked questions

Why should the IMEI be in the agreement?

The IMEI identifies the device uniquely – important as proof of ownership and in case the phone is later reported stolen. You find it in the settings or by dialing *#06# on the keypad.

What does “account removed and factory reset” mean?

Before handover the seller should remove the activation lock (iCloud or Google account) and reset the device to factory settings. Otherwise the buyer cannot use the phone. The checkbox in the agreement documents exactly that.

What if the phone breaks shortly after the purchase?

The agreement contains the usual warranty exclusion for private sales. That is why the condition and known defects (scratches, battery health) should be entered honestly in the condition field – fraudulently concealed defects are not covered by the exclusion.
