A residential rental agreement records rent, term, deposit and house rules. Even where verbal tenancies are technically valid, a written agreement is the standard – it is the primary evidence for everything agreed.

In England, most private tenancies are assured shorthold tenancies; deposits are capped at five weeks’ rent and must be protected in an approved scheme.

What matters for a tenancy agreement in England

A written tenancy agreement sets out the rent, the term and each side’s responsibilities. Tenancy law changed substantially in 2026, so a few statutory duties matter more than the wording of any template. (Scotland, Wales and Northern Ireland have their own rules.)

Protect the deposit within 30 days

A tenancy deposit must be protected in a government-approved tenancy deposit scheme within 30 days of receipt, and the prescribed information given to the tenant. Failing to protect it carries penalties and can block possession.

Deposit capped at five weeks’ rent

Under the Tenant Fees Act 2019 the deposit is capped at five weeks’ rent (or six weeks’ where the annual rent is £50,000 or more). Most other fees to tenants are banned.

Assured shorthold tenancies have been abolished

Since the Renters’ Rights Act 2025 came into force (1 May 2026), new tenancies in England are assured periodic (“rolling”) tenancies. Section 21 “no-fault” evictions have ended – a landlord now needs a valid Section 8 ground to seek possession.

How much deposit can I ask for?

Local rules vary; in many countries up to three months’ base rent is customary and permitted, often payable in installments. Enter the agreed amount in the deposit field.

Is a digital signature enough for a lease?
