How is ownership transferred in Malta?
Through Transport Malta: the transfer section on the back of the Vehicle Registration Certificate is completed and signed by buyer and seller together with witnesses, and the buyer needs insurance in place from the transfer date. The sale agreement is separate – it records the deal itself, the price and the condition.
What about the VRT test?
Vehicles in Malta undergo periodic VRT roadworthiness testing at stations licensed by Transport Malta. The test status belongs in the agreement, and the buyer will want to see the latest certificate – note when the next test falls due.
Is a digitally signed sale agreement valid?
A private car sale needs no special form, so it can be signed electronically – the signature is a simple electronic signature under the EU eIDAS Regulation, in force in Malta as in every EU country. The official transfer paperwork keeps its own wet-ink signatures; most people print the signed agreement for the handover as well.
The car has a fault the seller mentioned – is that covered?
Put it in writing. The as-seen clause covers the ordinary risk of a used car, not faults the seller concealed. Every known defect that goes into the condition field protects the seller from a later claim and tells the buyer what they are getting.
Can we sign it in both Maltese and English?
The template is in English, which is an official language of Malta alongside Maltese and standard for contracts. Nothing stops you adding a Maltese side note in the free-text field if both parties want it.
