Questions, answered

Does a private loan need a notary in Malta?
No – between private individuals a loan is valid without notarial form. What the written agreement adds is proof: that the money moved, that it was a loan and not a gift, and on what terms it returns. For substantial sums or security over property, notarial advice is money well spent.
May we agree interest?
Interest can be agreed between private parties, and Maltese law caps what may be charged – keep any rate moderate and state it plainly in the agreement. Plenty of family loans run interest-free on purpose; the template covers both routes.
Lump sum or instalments?
As you prefer: a single repayment date, or monthly instalments with a first-payment date. Early repayment is provided for, so paying back sooner is never a breach.
The loan is not being repaid – what now?
A written demand with a clear deadline comes first; legal action is the step after. The signed agreement plus the payout record are the case. Do not let an unpaid loan age quietly – limitation periods run in Malta as everywhere, so take advice early rather than late.
