In brief: cohabiting couples in Malta

Maltese law has come to recognise cohabitation through legislation, while the everyday finances of a shared household remain the couple’s own to arrange. A written agreement fixes those arrangements; the formal instruments – cohabitation, property, wills – pass through a notary.

Questions, answered

Where do unmarried couples stand under Maltese law?
Malta has legislated for cohabitation in recent years, and formally established cohabitation can carry defined rights and duties. The everyday financial questions, though, are yours to arrange – which is what this agreement does. For the formal route and its current requirements, a Maltese notary is the right address.
What weight does this agreement carry?
The weight of documented consensus: it proves what both of you agreed while you agreed on it, which in any later disagreement is worth a great deal. It does not replace the formal instruments Maltese law provides for cohabitation, property or inheritance – those pass through a notary.
What belongs inside?
The concrete and the recurring: the split of rent or mortgage contributions, the bills and who pays them, the joint account and its feeding, the ownership of joint purchases, and the mechanics of an amicable unwinding. Numbers and names beat sentiments.
What stays outside?
Succession above all: unmarried partners do not inherit from one another by default, so each partner needs a will – in Malta a matter for the notary. The same goes for immovable property: transfers and shared ownership take notarial deeds.
