Does a cohabitation agreement replace marriage?

No. It governs living together and the division of property between unmarried partners, but it creates none of the rights that come with marriage – such as automatic inheritance, spousal benefits or tax treatment. For real estate and estate planning, also see an attorney, and make a will in addition to the agreement.

Is living together for years the same as being married?

No. Only a handful of states still recognize new common-law marriages, and even there specific requirements apply – in most of the US no length of cohabitation creates a marriage. That is exactly why a written agreement matters: without one, unmarried partners have very little legal protection.
