In brief: the sublease agreement

A sublease is a rental agreement between the original tenant and a subtenant. Landlord-tenant law in the US is state (and often city) law, and most leases require the landlord’s written consent before subletting.

Subletting without permission can breach the lease and lead to eviction – get the consent in writing.
The original tenant remains fully responsible to the landlord for the rent and any damage.
Security deposit caps and return deadlines are set by state law and vary widely – check your state before setting the deposit.

Frequently asked questions

Do I need my landlord’s permission?

Usually yes. Most leases require the landlord’s written consent to sublet, and subletting without it can breach your lease and lead to eviction. Get the consent in writing – the agreement has a dedicated checkbox for it.

Fixed term or open-ended?

Both work. For a temporary let simply enter an end date. Without a fixed term the sublease runs open-ended with the notice periods that apply under your state and local landlord-tenant law.

How much security deposit can I ask for?

It depends on your state. Some states cap the security deposit (often one or two months’ rent) and set deadlines for returning it; others have no cap. Enter the agreed amount in the deposit field and check your local landlord-tenant law.

Can I sublet my place on Airbnb?

Only with your landlord’s consent – and check local law first: many US cities regulate, register or restrict short-term rentals, and a general permission to sublet normally does not cover short-term stays. Without consent you risk losing your lease.

Can we sign remotely?
