How is a promissory note different from a loan agreement?
A loan agreement is a two-sided contract that also covers disbursement and the lender’s duties. A promissory note is a one-sided written promise to pay by the borrower – shorter and mainly intended as evidence. For a full arrangement, use the loan agreement.
Does the lender sign too?
A classic promissory note is signed only by the borrower, who promises to pay. You can then give the PDF to the lender or have the lender countersign it via Tamgara.
Do I need a notary or witnesses?
No. A promissory note is enforceable when the borrower signs it – date, amount, parties and repayment terms are what matter. Notarization is not required, though it can help prove the signature is genuine. If the note bears interest, keep the rate within your state’s usury limits.
