In brief: the personal loan agreement

A loan between private individuals is valid in the US without a notary – what matters is written proof of the amount, the payout and the repayment terms. Interest is limited by state usury law.

State usury laws cap interest rates, and the limits differ significantly between states.
On larger interest-free family loans (generally above $10,000), the IRS may impute interest at the applicable federal rate (AFR).

Why put a personal loan in writing?

Especially among friends and family, a short agreement creates clarity: how much was lent, when is it due, is there interest? It also proves the money was a loan rather than a gift – that protects the relationship and both sides in a dispute.

Can I charge interest on a personal loan?

Yes, but state usury laws cap the interest rate you may charge, and the caps vary from state to state – check yours before agreeing on a rate. Many family loans are deliberately interest-free; note that on larger loans (generally above $10,000) the IRS may treat forgone interest as taxable “imputed” interest.

What about repayment in installments?

Simply enter the monthly installment and the date of the first one. Alternatively, agree on a fixed date for repaying the full amount.

Is the digitally signed agreement valid?
