Frequently asked questions

Who signs the security deposit receipt?
The person who received the deposit – usually the landlord. The signature confirms receipt of the amount for the rental property named in the receipt.
What if the deposit is paid in installments?
Simply issue a separate receipt for each installment, each with its own amount and date. That way both sides can prove exactly what has been paid so far.
Are there rules on how the deposit must be held?
In several states, yes: some require the deposit to be held in a separate or escrow account, some require the landlord to disclose where it is held, and a few require interest to be paid. Check your state and city landlord-tenant law – the receipt itself only confirms that the amount was received.
When does the deposit have to be returned?
Each state sets its own deadline after move-out and usually requires an itemized statement of any deductions. Normal wear and tear generally may not be deducted. Keep the receipt until the deposit has been fully settled.
Is a digitally signed receipt valid?
A receipt is generally form-free, and electronic signatures are valid under the federal ESIGN Act and state e-signature laws such as UETA (in New York: ESRA). The simple electronic signature created by Tamgara is perfectly sufficient as confirmation of receipt in a private tenancy.
